Varsha Sabhnani, 45, and her husband were told their home could also be seized because they committed their crimes there.

The pair, from Indonesia and India but naturalised Americans in Long Island, New York, face up to 40 years in jail after they paid the housemaids £50 a month, slashed them with knives and made them eat their vomit.

Sabhnani said: “I’m devastated. It will take me away from my children.”

The Liberhan Commission, probing the circumstances leading to demolition of Babri Masjid, was recently granted its 42nd extension which will end by December 31. It is the way India’s legal system offer justice to minority Muslims. That 15-year old Commission has already cost the state exchequer about Rs 7.20 crore! This is what we call Republic of India. Period.

I would say, Malaysian police is right in its argument about HINDRAF’s association with global terrorism. I don’t think LTTE is that much bad comparing to RSS of India, the Indian partner of HINDRAF. An American research centre has placed India’s ultra-nationalist Rashtriya Swayamsewak Sangh (RSS) on its terrorist list. The East Virginia-based Terrorism Research Center (TRC) is closely connected to the American government and many of its directors and researchers have closely worked with US administrations and have taken part in research and planning for the US administration. In the list of in India, the TRC has placed RSS under no. 21. Considering national security of India, RSS was banned thrice: 1948 (ploting to kill Mahatma Gandhi) , 1975 (national emergency), 1992 (Babri Masjid demolition). The bans were later lifted by judicial manipulation, but various governmental policing branches tagged them along with Islamic militants and still under close surveillance. There are still active campaigns by Indian diaspora to ban this extremist Hindu group around the world.

How RSS exported terror to Malaysia?

For long time, festivals and celebrations has been misused by RSS to promote its political agenda of intolerance. Recently, a national report on the employment situation in India has warned that nearly 30 percent of the country’s 716 million-strong workforce will be without jobs by 2020. When Indians are fleeing around the world to find a job, how can this hindutva idiots can claim on “National Pride of India”? Hindutva Idiots, Your false pride and actions make our life miserable.

Government of India doesn’t have the resources or political will to find jobs for such a large population. The Ministry of Foreign Affairs or Overseas Indians should not endorse the HINDRAF bigots as the sole representative of Malaysian Indians. A 2006 opinion poll by Outlook—AC Nielsen shows that 46 % of India’s urban class wants to settle down in US. Interestingly, in the Hindutva heart land of Gujarat, 54 % of people want to move to US. Cherian Samuel, a scholar at the Institute of Defence Studies and Anlyses (IDSA) says that Indian Americans totalled about 1.7 million in the US according to the 2000 census, their numbers having gone up by an incredible 106 percent since 1990. HINDRAF chief Waytha Moorthy asks India to impose sanctions on Malaysia

“India should impose trade sanctions on Malaysia to pressurize the latter to adopt affirmative policies to uplift the conditions of its citizens of Indian origin, says a Malaysian leader of a movement demanding better opportunities for Indians. Waytha Moorthy, president of Hindu Rights Action Force (Hindraf), was one of the chief organisers of a protest by Indian-origin Malaysians Nov 25 in Kuala Lumpur against alleged government discriminatory policies, which was met with stiff resistance from security authorities.”

Meanwhile, Singapore’s former Prime Minister Lee Kuan Yew also met Advani at his residence and the two shared their concern on the recent developments in Malaysia.”

Status of the Sri Lankan Tamil refugees

There were an estimated 1,60,000 Sri Lankan Tamil refugees in India, with over 55,000 of them living in refugee camps. The United Nations High Commissioner for Refugees has no mandate to operate directly in India.

Due to fresh upsurge of violence in Sri Lanka thousands of refugees fled to India creating problem of overcrowding in the existing camps. In October 2006, about 378 refugees belonging to 99 families were accommodated at Thappathy under Ettayapuram taluk in Tuticorin district from Mandapam camps due to overcrowding.

As on 19 September 2006, 13,844 refugees had reached the State since the influx began on 12 January 2006.

The conditions of these refugees were deplorable. According to the report of a fact-finding team of the Federation of Peoples’ Rights, young men arriving at the Mandapam camp were initially put into quarantine under conditions worse than those of a prison cell. The fact-finding team saw 39 male refugees lodged in a 20’x20′ space with only two toilets between them. Those suspected of having links with AOGs were referred to Special camps where they may be detained in quarantine for up to 30 days as per the stipulation of the Government of India.

The refugees also faced housing problems. The houses provided to them were 10’x10′ and not fit to live in. These houses were built at the end of the 1980s and no renovation had been done since then. During summer, it becomes inhospitable because of the scorching heat, while in rainy season the water pours through the damaged roofs. The camps lacked basic facilities including bathroom facilities, drinking water facilities, electricity, etc.

Muslims and Dalits discriminated in corporate India

For some time now and especially after publication of Sachar Committee Report Muslims put much emphasis on acquiring modern education. In rapidly globalized economy of India, education was promised to be the key to a brighter future for Muslim kids.

A recent study, however, finds that getting a call for interview can be reduced to as much as 33% for a candidate with Muslim names compared to an equivalent-qualified candidate with high caste Hindu name.

Study was lead by Chairperson of the University Grants Commission Prof. Sukhdeo Thorat and Paul Attewell of City University of New York. Beginning in October 2005 and lasting 66 weeks the study involved responding to job advertisements appearing in national and regional English newspapers with sets of resumes that were similar except for names. For each advertised position researchers sent applications with identical qualifications and experience that differed only in names. There was no explicit mention of caste or religion but names were easily identifiable as upper caste Hindu name, Dalit or Muslim names.

Only private companies were targeted and jobs that required little or no experience. In 66 weeks, researchers sent 4808 applications in response to 548 job advertisements. A call for interview or for a written test was considered a success for that application. Researchers were looking to see if chances of receiving an interview call are same for a high caste, a Dalit and a Muslim name.

Two statistical methods on the data resulted in a similar outcome. One method suggested that odds for a Dalit name is 0.67 and for a Muslim name is 0.33 to receive an interview call as compared to an equally qualified applicant with a high caste Hindu name. Another method gave the odds 0.68 and 0.35 for Dalits and Muslims, respectively. Both statistical models results are statistically significant which means that it is highly unlikely for this to happen by random chance.

The researchers concluded that “having a high-caste name considerably improves a job applicant’s chances of a positive outcome” adding that “on average, college-educated lower-caste and Muslim job applicants fare less well than equivalently- qualified applicants with high caste names, when applying by mail for employment with the modern private-enterprise sector.”

This is not surprising; Sachar Committee also found that private sectors had a dismal representation of Muslims. Sachar Committee recommended sensitizing private sector about diversity in their work force and suggested boosting Muslims recruitment through positive discrimination and affirmative action. Sachar Committee Report proposed the idea of an incentive based ‘diversity index.’

Sachar Committee Report also noted that “our data shows when Muslims appear for the prescribed tests and interviews their success rate is appreciable. This applies both to the public and private sector jobs.” But the present study suggests that any Muslim has about one third of a chance for landing that test or interview compared to a high caste Hindu.

Thorat and Attewell in their research article published in October 13th, 2007 issue of Economic and Political Weekly write that despite legal safeguards when a social group remains backward then it is blamed on group’s low level of education. These two who have been studying discrimination in United States and India states that discrimination is not acknowledged in a modern capitalist economy.

This study conclusively proves that there is discrimination in corporate India against Dalits and Muslims, with Muslims suffering the most.

“These were all highly-educated and appropriately qualified applicants attempting to enter the modern private sector, yet even in this sector, caste and religion proved influential in determining ones job chances,” researchers commented.

Mr C.V. Devan Nair and the Malayalis

CHENGARA VEETIL DEVAN NAIR, or C.V. Devan Nair, is dead. Not where he was born – in Malacca, Malaysia; not in the land of his adoption, Singapore whose president he became; but in exile in Canada, hounded to the end by Mr Lee Kuan Yew, then prime minister but now two steps higher as minister mentor, whose colleague he was and who had him elected as President. He was born in 1923, and died in December 2005. He was, of course, a Malayali, a clan Mr Lee was, and is, afraid of, and who gave him his biggest trouble in his march to be Prime Minister. He regarded them more dangerous than snakes, and did not look upon them kindly.

Mr Devan Nair was weaned into Mr Lee’s People’s Action Party, from the pro-communist Anti-British League, and later, so Mr Lee’s supporters said, he sold his friends to be firmly entrenched with Mr Lee. Mr Nair never wrote his memoirs, so we will never know the truth of this. He was an active writer since 1954, but wrote less and less after he was removed as President in 1993. In 1999, he attracted a libel suit from Mr Lee for what he wrote in Canada, but which was thrown out after his counter-claim. He married a Tamil, who died before he did, had four sons and five daughters.

Why he resigned as President is shrouded in mystery. Mr Lee said he resigned to be treated for alcoholism. Mr Nair said he resigned because of political conflicts with Mr Lee, and asked to resign, failing which Mr Lee said he would be removed by a motion in parliament. Mr Nair said his bizarre behaviour was officially induced: he was given drugs that made him act irrationally. At the time of his resignation, he is said to have grabbed the breasts of a Sarawak state minister’s wife, when he was on an official visit. The minister’s wife later told me the incident was true, but anyone who would would have who otherwise would have fallen into the pool, and was shocked to find the incident treated as an indecent aberaration. Mr Lee wanted him out, and his reason was as good as any! No one questioned his version, or asked Mr Nair for his. In Singapore. Then as today, what he says goes. Mr Lee, who is of the same age as Mr Nair, is minister mentor of Singapore, two steps higher than the Prime Minister. And so Mr Nair became a non-person. There was a humiliating condition to his pension, that he had to get a certificate from a competent authority that he was not an alcoholic before he got it. He rejected it, rightly. The only pension he got was from the Malaysian parliament, where was elected to in 1964, when Singapore was part of Malaysia. He remained in Malaysia after Singapore was ejected in 1965.

He was the son of I.V.K. Nair, from Palghat, who had come to Malaysia in 1910, and was brought to the then Federated Malay States. He appointed agents later in all districts. That is how Inspector P.C. Joseph. from Alwaye, and my father, from Thalavady, came to Malaysia. It was to Inspector Joseph’s house in Johore Bahru I was taken after I was born at the General Hospital in Johore Bahru in 1939. James Puthucheary, who joined the Indian National Army in his twenties, was in detention with Mr Nair, when his father in 1956 died. He was among the small band of Malayalis who provided the PAP with the left intellectual framework, for which they were exiled in old age. Mr Puthucheary studied law, died a rich corporate lawyer in Malaysia, believed to the end he had failed. He said to me he would title his autobiography, which he never wrote mainly because of the stroke that ravaged his last days, “The Autobiography of a Failure.” He was banned for almost 25 years from the island, lifted after his friend’s wife died in Singapore, he wanted to attend the funeral, and just before he did. As an aside, I was put on restricted entry into Singapore in 1971, and permanently banned in 1991. But as I told an Italian journalist, who put the quote in his book, “I have already done my shopping.”

But Singapore cannot escape from Malayalis. The republic has put a statue for a Nair, who came to Singapore in 1819 as cook to Sir Stamford Raffles, the island’s ‘founder’. The history of modern Singapore is peppered with Malayalis. Some were exiled to Kerala, whence they came, but many are in Singapore, out of politics, but gather whenever a like minded spirit passes away. Today, if the modern Indian plays a prominent role, he is usually not a Malayali. But it has to live with many whom it detained in the past. The PAP had all the seats in Parliament until 1981, when Mr Nair vacated his Anson seat to become president. His successor is Mr J.B. Jayeratnam, a lawyer who is facing bankruptcy by the PAP and is reduced these days to selling his law books to escape bankruptcy.

In Malaysia, those expelled from Singapore did provide the intellectual framework for much of its policies, although some had occasion to regret what they did. The former prime minister, Tun Mahathir Mohamed, in his eighties and had a heart attack around Christmas last year, is the grandson of a Malayali policeman from Travancore who became head of security to the sultan of Kedah. Many others though came here to earn a living, fought for Indian independence, and returned to serve the Indian government on independence. Among those were N. Raghavan, a lawyer who became India’s ambassador to Argentina. Dr N.K. Nair practiced medicine in Penang, fought for Indian independence, married a German, and remained in Malaysia. His son died as a UN representtive in Thailand. But they are a minority in Singapore and Malaysia. In Singapore, they are looked down upon officially. In Malaysia, they are look down upon by the Tamils, who represent the Indians in power. They cannot join the Malaysian Indian Congress, unless they forget Malayalam and adopt Tamil. But in either territory, they cannot be ignored. Once in a blue moon, someone like C.V. Devan Nair would arise to make their presence felt.

NRI saga goes back over 2,500 years

For most of the new NRI generation, the Indian migration started about 60 years or 100 years at the most. But this saga goes back over 2,500 years ago much before Biblical times to distant shores of Africa, South-East Asia and the Far East. Considering that they travelled by sailboats into uncharted seas in voyages that took months to the Far East, it remains a humongous achievement.

Most of the second NRI generation in the US and Britain traces its roots to their fathers who left their motherland after India became independent. Canada is an exception as sturdy Punjabi farmers settled there earlier around 1930s. NRIs in East and South Africa, Mauritius and the Caribbean go back to just over a century when their forefathers went abroad to work as labourers to build a railway in East Africa or work on sugar plantations.

While Sri Lanka and Myanmar are just over the horizon for Indian seafarers, negotiating tricky straits and storms to land in Java, Sumatra, Cambodia, Vietnam, Bali and the Philippines demonstrated their real test of skill and endurance over 2,500 years ago. Sailing west was relatively easy as the annual monsoon winds carried their sailboats from Kutch to the Gulf and then south to East Africa and a few months later, they returned as the winds changed into the opposite direction.

‘The diaspora of Indians in ancient times to the countries of South East Asia and the annals of those kingdoms by the Hindu colonists were quite unlike the later European ways of colonization,’ writes Utpal K. Banerjee in his new book ‘Hindu Joy of Life’, ‘Among the European powers were the English, Dutch, French, Portuguese and Spaniards, all five of which acted with explicit support of home government and were accompanied by military forces to back them to forcibly impose supremacy over the people of other countries; mainly to exploit the resources of the colony and benefit their homeland.’

The Indians, on the contrary, enriched the native populations by introducing the art of writing, high degree of culture, improved methods of cultivation, improved handicrafts and introduced new industries, claims Banerjee. ‘Indians went out of their country without any sort of backing of any of the Indian states,’ he said. ‘Hindus left their motherland to settle abroad in colonies and not to make fortune and run back to motherland. It was diaspora in the truest sense, where the penetration of Hindu civilization, culture, languages in South East Asia took place so peacefully that the indigenous population never felt that their country had been taken over.’ Here is a book that chronicles the 2,500 years of Indian settlement abroad in lucid terms in one of its chapters. After the abolition of slavery, the planters needed farm workers and so they tapped the huge manpower resource of India for the sugar plantations of Jamaica, South Africa and Mauritius from UP and Bihar. They needed workers to build the Kenya Uganda Railway towards the end of the 19th century, so they sent them from Punjab. They needed farmers for the hostile lands of Canada and so Punjabi farmers were allowed in.

After the Second World War, both Britain and the US needed factory workers, skilled professionals and admitted Indians in large numbers from 1960 onwards. The latest flow of Indian immigrants to the US, Britain and Canada came from east Africa in the 1960s to 1980s when the independent African governments wanted to provide jobs for their indigenous peoples. At the end of the last century, Indian IT workers went to fix the Millennium Bug in the computer systems followed by thousands of IT professionals.

Wherever NRIs settled, they have prospered. As law-abiding citizens by and large, they have preserved enduring Indian values. And they have maintained their links with India from distant lands through their way of life. Banerjee pays NRIs a warm tribute by writing, ‘This is no mean achievement, in spite of the initial handicaps and owes a lot to the innate vitality of the Indian civilization.’ In brief, India has always been ‘a soft super power’.

Bharatiya Janata Party (BJP) MP Babubhai Katara, arrested for allegedly trying to smuggle people abroad, has told the police that he was paid Rs 800,000 for every person he helped to go abroad illegally, with his aide and travel agents pocketing most of the money made in the deals.

“I was given only Rs 800,000. I really don’t know if they charged Rs 3 or 4 million for sending people abroad with me,” Katara told officers interrogating him.

He stated this when confronted with statements of his aide Rajender Gampa and some travel agents that they used to charge Rs 3 to 4 million from each person who flew abroad in the company of the MP on the latter’s family’s passports.

Police say they have evidence that Katara and his associates were involved in flying out at least 12 people to the US and Britain. The Gujarat politician had personally taken six people with him.

“They have fooled me,” a police official quoted the MP as telling investigators during interrogation.

“Though he was paid a handsome amount, it were the agents and others involved in the human trafficking racket who arranged for the passports and clients and so took a larger share of the booty,” a senior police official told.

“Our investigations show that these travel agents were in some kind of agreement with the MPs and paid them a fixed amount every time they smuggled out a client abroad. Katara was given Rs 800,000. The rest of the money was distributed among the MP’s aides and agents,” the officer added.

Katara, who had reportedly earned around Rs 3.5 million through human trafficking, was apparently not aware that Sunder Lal Yadav, a travel agent, earned more than him simply by arranging the clients and documents.

The investigating officer also revealed that travel agents identified people who could cough up Rs 3 million to travel abroad. The agents had a wide and well-organised network spread through the small towns and cities in Punjab to the big cities in Andhra Pradesh.

The Crime Branch of Delhi Police, which is conducting the investigation, has identified five travel agents involved in the racket. Three are from Punjab (Joginder Singh, Santhu Masih and Harbhajan Singh), Hyderabad and New Delhi.

The racket came to light on April 18 when Katara was arrested at the airport in New Delhi while trying to fly out a woman, Paramjeet Kaur, and a 15-year-old boy Amarjeet Singh on the passports of his wife and son.

Police later arrested Gampa, Sunder Lal Yadav and their female accomplice Kiran Dhar on charges of forging documents and passports. Yadav was charged with arranging the visas.

Kiran allegedly taught women flying abroad how to act like an MP’s wife – and how to conduct before immigration officers.

Yadav told a court in New Delhi that three Bahujan Samaj Party (BSP) MPs from Uttar Pradesh – Mitrasen Yadav, Ashok Rawat and Mohammed Tahir Khan – and Ramswaroop Koli of BJP from Rajasthan were also involved in the racket.

And Gampa told the court that Katara as well Mitrasen Yadav and Ashok Rawat knew that he was using their letterheads to help people immigrate illegally.

Chennai visitors no longer entitled to visa-on-arrival programme in Malaysia

PUTRAJAYA: Visitors from Chennai, India, are no longer eligible for the visa-on-arrival (VOA) when they land in Malaysia.

They now have to obtain their visas in their own country before entering Malaysia, said Home Affairs Ministers Datuk Seri Radzi Sheikh Ahmad. The ruling took effect from Nov 29.

The VOA, introduced for 24 countries requiring a visa to enter Malaysia was enforced on Sept 1, and available with a RM100 fee at immigration counters. It is valid for a month.

It was introduced to draw an expected 21 million people during the Visit Malaysia Year 2007 period. Among the countries are China, India, Pakistan, Bangladesh and Myanmar.

Up to Nov 6, over 14,500 visitors had applied for the VOA, of which more than 10,000 were from India.

The others were from China (1,634), Sri Lanka (980), Bangladesh (862) and Pakistan (796).

Records showed that 2,789 Indian tourists had overstayed, followed by 355 from China.

Home Affairs Minister Datuk Seri Radzi Sheikh Ahmad said the Cabinet decided last week that the VOA would no longer be issued to those from Chennai as too many of them had over stayed.

“Due to many of them remaining in the country after the visa expired, I submitted a Cabinet paper to put a stop to it. The Cabinet agreed.

“I do not know how long the VOA freeze will be on those from Chennai but the number of overstaying tourists will be monitored from time to time,” he told reporters after launch ing the Biometrics Security System and the ministry’s Immigration Identity Card, cre ated by Multimedia Glory Sdn Bhd, here Friday.

Under the biometrics system the fingerprints of foreign workers are recorded to ensure they are legal workers right from the time they leave their country of origin.

It takes about 0.5 seconds to read the fingerprints, which, he said, was faster than the American system, which took about 40 seconds.

Workers from Bangladesh have been using the system for a year and it has been found to be successful in detecting many illegal workers, he said, adding that it will soon be introduced to workers from other source countries.

“There are about 1.9 million foreign workers in the country with illegal workers numbering between 500,000 and 700,000,” said Radzi.

He plans to have the system at the National Registration Department to enable all min istries and agencies to retrieve data of all Malaysians from one single platform.

On the Immigration Identity Card, he said, it had high security features and that students, workers from various sectors and those regarding Malaysia their second home would be issued with separate cards dif ferentiated by colours.

Workers who renewed their permits next year will be issued with the new cards while issuance of new cards for others will start with university students first, who numbered about 40,000, he said.
